1. About these Terms

1.1 These Terms of Service (“Terms”) govern your access to and use of the website at tozrituals.org and all associated pages, content, features, and resources (together, the “Site” or “ToZ Rituals”), which is operated by Temple of Zeus Foundation (the “Foundation”, “we”, “us”, “our”), a private interest foundation with legal personality under Law No. 25 of 12 June 1995 and other applicable law of the Republic of Panama.

1.2 By accessing or using the Site, you (“you”, the “visitor”) agree to these Terms. If you do not agree, you must not access or use the Site.

1.3 ToZ Rituals is a sister project of the Temple of Zeus. Some resources reference or link to other properties of the Foundation, including the Temple of Zeus (templeofzeus.org) and the Hall of Osiris. Those properties have their own terms, which govern your use of them.

1.4 These Terms should be read together with our Privacy Policy and Cookie Policy, which are incorporated into these Terms by reference.

2. Definitions and interpretation

2.1 “Services” means the Site and all content, pages, features, resources, ritual materials, schedules, tools, and communications made available on or through tozrituals.org, whether or not any payment is made.

2.2 “Content” means all material made available on or through the Site, including text, images, sigils, designs, schedules, audio, and code.

2.3 “Authorised Person” means any officer, council member, member, volunteer, contributor, agent, or service provider of the Foundation.

2.4 In these Terms: headings are for convenience only; the singular includes the plural and vice versa; “including” and “in particular” are without limitation; and a reference to a law includes that law as amended or replaced.

3. Nature of the Site; devotional and religious character

3.1 ToZ Rituals is a religious and devotional resource of the Foundation. It provides information, texts, schedules, and materials concerning rites, meditation, and spiritual practice, for study and personal use.

3.2 The Content is offered for religious, educational, and informational purposes only. It reflects the beliefs and practices of the Foundation and its community, is a matter of faith and personal conviction, and is not presented as, and must not be relied upon as, a statement of objective fact or as advice of any regulated kind.

3.3 Participation in any practice described on the Site is entirely voluntary.

4. No professional relationship; no promised outcome

4.1 Nothing on the Site constitutes medical, psychological, psychiatric, health, legal, financial, tax, investment, safety, or other regulated professional advice, and no such professional relationship is created by your use of the Site.

4.2 The Foundation does not promise or guarantee any spiritual, religious, emotional, physical, psychological, financial, or other outcome from any Content, rite, meditation, or practice.

4.3 You should obtain advice from an appropriately qualified professional before doing anything that could affect your health, finances, safety, or legal position. If you are experiencing a medical or psychological emergency, contact your local emergency services.

5. Eligibility and age

5.1 The Site is intended for a general adult audience and is not directed to children. It is not intended for and must not be used by anyone under the age of 13, and certain materials of a mature devotional nature are intended only for adults aged 18 or over.

5.2 By using the Site you represent that you are at least the age of majority in your place of residence, or that you are at least 13 and have the consent of a parent or legal guardian, and that your access and use are lawful where you are.

5.3 The Foundation may restrict access to some or all Content by age or location.

6. Gratuitous provision; no consideration

6.1 The Services are provided free of charge. The Foundation does not sell goods or services through the Site, does not solicit or accept payment or donations through the Site, and asks nothing of you in exchange for access.

6.2 Because the Services are provided gratuitously and without consideration or obligation, they are made available on an “as is” and “as available” basis to the fullest extent permitted by law, and the disclaimers and limitations in these Terms apply with full force, consistent with the voluntary, no-cost nature of the Services.

6.3 Any donation to or support of the Foundation is handled separately, through other properties of the Foundation, under the terms applicable there. These Terms do not govern donations, and no provision of these Terms limits any liability in respect of money you pay to any other person or entity.

7. Access and security

7.1 The Site has no login and no user accounts. You can browse it without registering or signing in, and there is no public registration.

7.2 Administration of the Foundation’s content is handled through a separate, restricted system that is not part of the Site and is governed by its own internal terms. No visitor-facing login exists on the Site.

7.3 You must not attempt to access any non-public system, interface, or area, or to breach or circumvent any security, authentication, or access-control measure.

8. Acceptable use

8.1 You agree to use the Site lawfully and in accordance with these Terms. In particular, you must not:

  • breach any applicable law or regulation, or infringe the rights of any person;
  • access, probe, scan, or test the vulnerability of the Site or its infrastructure, or breach or circumvent any security, authentication, or access-control measure, without our prior written authorisation;
  • introduce any malware or harmful code, or interfere with, disrupt, or place an unreasonable load on the Site, including by scraping, crawling, harvesting, or automated data collection, or by any denial-of-service technique, without our prior written consent;
  • copy, reproduce, republish, frame, mirror, distribute, or create derivative works from the Content, except as expressly permitted by these Terms or by law;
  • misrepresent your identity or affiliation, or create a false impression of association with, or endorsement by, the Foundation;
  • use the Site to harass, threaten, defame, or harm any person, or to store or transmit unlawful, infringing, or malicious material; or
  • remove, obscure, or alter any proprietary or legal notice on the Site.

8.2 We may investigate and take any action we consider appropriate for any suspected breach, including restricting access, removing material, and cooperating with the authorities.

9. Assumption of risk in spiritual and physical practices

9.1 Some Content describes rites, meditations, breathing techniques, fasting, physical postures, or other practices. Such practices may not be suitable for everyone and may carry risks to health or wellbeing.

9.2 You undertake any practice described on the Site voluntarily, at your own risk, and on your own responsibility, after exercising your own judgement and, where appropriate, obtaining professional advice. To the fullest extent permitted by law, you assume all risk arising from your engagement in any such practice.

9.3 Nothing in this section limits any liability that cannot be limited under applicable law, including liability for death or personal injury caused by negligence where the law does not permit its exclusion.

10. Intellectual property and trademarks

10.1 All Content, and all intellectual property rights in the Site and the Content, are owned by or licensed to the Foundation and are protected by law. All rights not expressly granted are reserved.

10.2 “Temple of Zeus” is a trademark of the Foundation, including under Swiss registration Swissreg 848781 and European Union trade mark EUIPO 019363328. Other names, marks, logos, sigils, and designs used on the Site are trademarks or protected works of the Foundation unless otherwise indicated.

10.3 Subject to your compliance with these Terms, the Foundation grants you a limited, personal, non-exclusive, non-transferable, revocable licence to access and view the Content for your own personal, non-commercial, devotional, or study use. All other use requires our prior written consent.

10.4 You must not use any name, mark, sigil, or protected material of the Foundation in a way likely to cause confusion, to imply affiliation or endorsement, or that reproduces, alters, or exploits it, without the Foundation’s prior written consent.

11. Material you send us

11.1 The Site is not designed to receive public submissions. If, through any feature or by contacting us, you send the Foundation any material, feedback, or suggestion, you grant the Foundation a non-exclusive, worldwide, royalty-free, irrevocable licence to use, store, reproduce, adapt, and act on it, without obligation or compensation, to the fullest extent permitted by law.

11.2 You are responsible for anything you send, and you represent that you have the right to send it and that it does not infringe any right or breach any law.

12. Third-party links and resources

12.1 The Site may link to or reference third-party websites and resources and other properties of the Foundation. Links are provided for convenience and do not signify endorsement.

12.2 The Foundation does not control and is not responsible for third-party content, services, or practices. Your use of any third-party resource is governed by that third party’s terms.

12.3 The Site loads web fonts from Google Fonts; the associated data flow is described in the Privacy Policy and Cookie Policy.

13. Availability and changes to the Site

13.1 The Foundation may add to, change, suspend, restrict, or discontinue any part of the Site at any time, with or without notice, and does not guarantee that the Site will be available, uninterrupted, timely, secure, or error-free.

13.2 The Foundation may impose limits on certain features or restrict access to parts of the Site without liability.

14. Disclaimer of warranties

14.1 To the fullest extent permitted by law, the Site and the Content are provided “as is” and “as available”, without warranties or conditions of any kind, whether express, implied, or statutory, including implied warranties of merchantability, satisfactory quality, fitness for a particular purpose, title, accuracy, and non-infringement.

14.2 The Foundation does not warrant that the Content is accurate, complete, current, or reliable, or that the Site is free of errors or harmful components.

14.3 Some jurisdictions do not allow the exclusion of certain warranties. In that case, the excluded warranties apply only to the minimum extent required by law, and nothing in these Terms affects non-waivable rights you have as a consumer.

15. Limitation of liability

15.1 To the fullest extent permitted by applicable law, the Foundation and each Authorised Person will not be liable for any indirect, incidental, special, exemplary, punitive, or consequential loss, or for any loss of data, profit, revenue, goodwill, opportunity, reputation, anticipated savings, or anticipated benefit, arising from or connected with the Services, even if the possibility was known.

15.2 To the fullest extent permitted by law, and given that the Services are provided free of charge and without consideration, where a monetary cap on liability is enforceable the Foundation’s total aggregate liability arising from or connected with the Services will not exceed the greater of (a) the total amount, if any, you actually paid to the Foundation in respect of the Services in the twelve (12) months before the event giving rise to the claim, or (b) one hundred United States dollars (USD 100).

15.3 These limitations do not apply to liability for fraud or fraudulent misrepresentation, for wilful misconduct, for death or personal injury caused by negligence where liability cannot lawfully be limited, for breach of a non-waivable consumer right, or for any other liability that applicable law does not permit to be excluded or limited. Different jurisdictions provide different rights; where a limitation is not permitted, it applies only to the maximum extent lawful, and the remaining provisions continue in effect.

16. Indemnity

16.1 To the fullest extent permitted by law, you agree to indemnify and hold harmless the Foundation and each Authorised Person from and against any third-party claims, liabilities, losses, and reasonable costs (including reasonable legal fees) arising out of your breach of these Terms, your misuse of the Site, or your violation of any law or the rights of any person. This clause does not apply to the extent a loss results from the Foundation’s own fraud, wilful misconduct, or negligence, or where it would remove a non-waivable consumer right.

16.2 The Foundation will give you reasonable notice of any claim to which this indemnity may apply, and may, at its option, participate in or assume the defence and settlement of that claim.

17. Complaints about content and intellectual property (notice-and-action)

17.1 The Foundation respects the rights of others and expects visitors to do the same. If you believe any Content infringes your rights or is unlawful, contact us at [email protected] with: your contact details; identification of the material and its location (URL); a description of the right or law in issue; and, for intellectual-property complaints, a statement of your good-faith belief and, where you act under the United States Digital Millennium Copyright Act (DMCA), the statements and signature that Act requires.

17.2 The Foundation operates a notice-and-action process consistent with applicable law, including the EU Digital Services Act. We will consider properly submitted notices and may remove or disable access to material, and take other action, as we consider appropriate. Our single point of contact for such notices and for the authorities is [email protected], in the English language.

18. Suspension and termination

18.1 The Foundation may suspend or terminate your access to the Site at any time, without notice, where it considers this necessary or appropriate, including for any breach of these Terms or of any applicable law.

18.2 Provisions that by their nature should survive termination (including sections 6, 9, 10, 11, 14, 15, 16, 20, and 23) survive.

19. Force majeure

19.1 The Foundation is not liable for any failure or delay in making the Site available to the extent caused by events beyond its reasonable control, including acts of God, natural disasters, war, terrorism, civil unrest, labour disputes, epidemic or pandemic, failure of utilities or communications networks, hosting or third-party service failures, or governmental action.

20. Governing law and jurisdiction

20.1 These Terms, and any dispute or claim arising out of or in connection with them or with the Site (including non-contractual disputes or claims), are governed by the laws of the Republic of Panama, without regard to conflict-of-laws rules.

20.2 The courts of the Republic of Panama will have jurisdiction, and you submit to that jurisdiction. Nothing in this section deprives you of the protection of the mandatory rules, or of any right to bring proceedings in the courts, of the country where you reside, where applicable law gives you that protection. Where you are a consumer, you may have the right to bring proceedings in your home courts and to rely on the mandatory law of your country of residence, and nothing in these Terms limits those rights.

21. Resolving disputes

21.1 If you have a concern, please contact us first at [email protected] so we can try to resolve it informally. Many issues can be resolved quickly this way.

21.2 Nothing in these Terms requires you to waive any non-waivable right, including any right to bring a claim before a competent authority or court or, where available, to use an alternative or online dispute-resolution mechanism.

22. Changes to these Terms

22.1 The Foundation may update these Terms from time to time. The current version will always be posted on the Site with its effective date. Material changes take effect when posted, and your continued use of the Site after that constitutes acceptance. If you do not agree to a change, you must stop using the Site.

23. General

23.1 Entire agreement. These Terms, together with the Privacy Policy and Cookie Policy, are the entire agreement between you and the Foundation about the Site and supersede prior understandings on that subject.

23.2 Severability. If any provision is held invalid or unenforceable, it is modified to the minimum extent necessary to make it enforceable or, if that is not possible, severed, and the remaining provisions continue in effect.

23.3 No waiver. A failure or delay in enforcing any provision is not a waiver of it.

23.4 Assignment. You may not assign or transfer these Terms. The Foundation may assign them to a successor or affiliate.

23.5 Third parties. Except that each Authorised Person may enforce provisions expressed to benefit them, no one other than you and the Foundation has any right to enforce these Terms.

23.6 Relationship. Nothing in these Terms creates any membership, agency, partnership, employment, fiduciary, or joint-venture relationship, and no person acquires any status, right, or authority in respect of the Foundation except by a current written instrument or as required by law.

23.7 Notices. Notices to the Foundation should be sent to [email protected].

23.8 Language. These Terms are drafted in English; any translation is provided for convenience only, and the English version prevails to the extent permitted by law.
